NYC Rent Freeze 2026: Why the 2-Year Lease Is Suddenly the Smart Move

On June 25, 2026, the NYC Rent Guidelines Board voted 7 to 1 to freeze rents at 0% for BOTH 1-year and 2-year leases on rent-stabilized units, for lease terms that begin between October 1, 2026 and September 30, 2027. It is the first 2-year freeze in the board's history. If your stabilized lease renews in that window, signing the 2-year option locks 0% for two full years.

Most renters have a rule of thumb in their head: the 2-year lease always costs more. This cycle, that rule is wrong. Here is what changed, who it covers, and the one date that decides whether it applies to you.

What exactly did the board approve?

Every year the Rent Guidelines Board sets the maximum increase a landlord can apply to a rent-stabilized lease renewal. For the 2026 to 2027 cycle the board approved:

  • 1-year renewal: 0%
  • 2-year renewal: 0%

Past freezes only ever covered the 1-year option, and the 2-year always carried a higher rate. A freeze on both is new. The vote delivered on Mayor Mamdani's campaign pledge, and he had appointed 6 of the board's 9 members.

What to do: If you are stabilized and your renewal falls in the window, do not assume the 2-year costs more this time. It does not.

Which leases does the freeze cover?

Two conditions, both required:

  • The unit is rent-stabilized (roughly a million NYC units are).
  • The new lease term begins between October 1, 2026 and September 30, 2027.

The date that matters is when the lease term starts, not when you sign it. A renewal signed in August 2026 that starts November 1, 2026 is covered. A renewal that starts September 1, 2026 falls under the previous cycle's rates.

What to do: Find the start date on your renewal offer before anything else. That single date decides which cycle's numbers apply.

Why is the 2-year lease the smart move this cycle?

Because it locks 0% for two years instead of one, and it protects you from whatever the board votes next.

Nobody knows what the 2027 board will approve. If you take the 1-year at 0%, you are back at the table in 2027 facing that unknown. If you take the 2-year at 0%, you have flat rent through 2028. The usual price of that safety was a higher 2-year rate. This cycle the safety is free.

What to do: Unless you plan to leave the apartment within a year, take the 2-year option.

My landlord's renewal offer shows an increase. Is that legal?

If the unit is stabilized and the term starts in the freeze window, an increase above 0% is not allowed. Renters accept illegal increases all the time simply because they did not know the number for their cycle.

A renter in Flatbush asked exactly this on Reddit: "should I just take this increase and resign? just need a sanity check on if we think 5% is a fair increase." The crowd debated whether 5% was fair. The real first question was whether the unit was stabilized, because if it was, the legal number for the next cycle is zero.

What to do: First confirm the unit is stabilized (request the rent history from HCR, it is free). Then check the lease start date against the window. If both line up and the offer shows an increase, point at the RGB order in writing.

What if I'm not sure my apartment is stabilized?

Landlords do not always volunteer it. Signs that point to stabilized: the building has 6 or more units and was built before 1974, your lease includes a stabilization rider, or the building got a tax break like 421-a. The certain way to know is your rent history from HCR, which shows the unit's registration.

What to do: Request the rent history before your renewal deadline. It settles the question and sometimes reveals past overcharges too.

Common questions

Does the 2026 rent freeze apply to market-rate apartments?

No. The freeze covers rent-stabilized units only. Market-rate increases are set by the lease and, in many buildings, limited by the Good Cause Eviction law instead.

My renewal starts September 2026. Do I get the freeze?

No. The freeze covers lease terms beginning October 1, 2026 through September 30, 2027. A term starting before October 1 falls under the previous guideline. If you can lawfully shift your renewal start into the window, that changes the math.

Is a 2-year lease riskier if I might move out?

Breaking any lease has costs, so a 2-year is a real commitment. If moving within a year is likely, the 1-year at 0% is the cleaner fit. If you are staying, the 2-year locks the freeze through 2028.

Can my landlord refuse to renew because of the freeze?

Not for a stabilized tenant. Stabilization includes the right to a renewal lease. A landlord who suddenly "needs the unit" after a freeze vote deserves skepticism and a call to HCR.
